Meta Flow Ltd. (“Meta Flow”, “Company” “we” or “us”) respect the privacy of its users (“User(s)” or “you”), and are committed to protect the Personal Information that you share with us in connection with the use of the Service.

This Privacy Policy (the “Privacy Policy”) is intended to describe our practices regarding the information we may collect from you when you use the Lumen Device and the Services (or any part thereof), the manners in which we may use such information, and the options and rights available to you.

Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use available at http://www.metaflow.co/terms-of-use (the “TOU”), which this Privacy Policy is incorporated thereto by reference.

BY ENTERING, CONNECTING TO, ACCESSING OR USING THE SERVICE (OR ANY PART THEREOF), YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY, INCLUDING THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION. IF YOU DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT ACCESS AND/OR USE THE SERVICES IN ANY MANNER WHATSOEVER.

YOU ARE NOT OBLIGATED TO PROVIDE US WITH ANY PERSONAL INFORMATION. YOU HEREBY ACKNOWLEDGE AND AGREE THAT YOU ARE PROVIDING US WITH SUCH INFORMATION AT YOUR OWN FREE WILL, FOR THE PURPOSES DESCRIBED HEREIN, AND THAT WE MAY RETAIN SUCH PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND ANY APPLICABLE LAWS AND REGULATIONS.

1. Information We May Collect On Our Users

We may collect two types of data and information from our Users. The first type of information is non- identifiable and anonymous information (“Non-Personal Information”). We are not aware of the identity of the User from which we have collected the Non-Personal Information. Non-Personal Information is any unconcealed information which is available to us while Users are using the Service. Non-Personal Information which is being gathered consists of technical information and behavioral information, and may contain, among other things, the activity of the User on the Service, identity and operation system and browser type and version, screen resolution, type of mobile device, and operating system version, User’s screen resolution, duration of usage of the Service, User's Lumen Device information (Device ID, casing, description, type of sensor, firmware, battery level, pressure, and any other technical device information), User’s ‘click- stream’ and activities on the Services, browser and keyboard language, the period of time the User visited the Services and related time stamps, etc.

The second type of information is individually identifiable information (“Personal Information”). This information may, in itself or taken together with additional information available to Meta Flow, identify an individual, or may be of a private and/or sensitive nature. Personal Information we collect includes: full name, username, email address, photographs (including photographs of yourself and others), date of birth, height, gender, weight, phone number, your geo-location, your fitness and health habits, Metabolic Data, Physical Information, and all User-generated data, User’s reports and reviews regarding the Services, your in-app settings, User IP address, UDID (Unique Device Identifier) or other persistent User and/or mobile device token as applicable), and any additional information which the User actively chooses to provide.

We collect such information via your use of the Services and through information which you voluntarily provide and/or upload to the Services as further described in this Privacy Policy below, for purposes of providing the Services, enhancing the User's experience and personalizing the Service and security purposes as further detailed below and.

In the event that you create an Account via Facebook Meta Flow may also have access to your public profile, which includes your name, gender, age group and residency, email address, your Facebook friends contact list, your Facebook profile photo.

By registering for the Services you further agree to provide us with access to any and all information available on your health kit account (such as Apple Health Kit, Android Fit, etc.).

For the avoidance of doubt, any Non-Personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists. In this context it is important to note that information comprising your Personal Physical Profile (“Personal Physical Profile Information”) may be categorized as either Personal Information or Non-Personal Information in accordance with the definitions above and the characteristics of each specific item of the Personal Physical Profile.

We will not collect any Personal and Personal Physical Profile Information from you or related to you without your approval, which is obtained, inter alia, through your active acceptance of the TOU and this Privacy Policy.

2. How We Collect Information of Our Users

We use the following methods of collection:
(i) Use of the Services. We collect Non-Personal and Personal Information (including Personal Physical Profile Information) when you access or use the Services. In other words, we are aware of your usage of the Services and may gather, collect and record the information relating to such usage. We also collect Non-Personal and Personal Information derived from information we receive from third party services and providers we work with.

(ii) Voluntarily Provided. We may collect Personal Information which you voluntarily provide when you use the Services. We may also collect information provided via your social network account in the event that you voluntarily choose to create an Account via such third party social networks (like Facebook). We may also collect Non-Personal Information through the processing, analysis and anonymization of Personal or Personal Physical Profile Information provided by you.

3. How We Use Your Information

Your information is collected for purposes: (i) to provide you with and to operate the Services, including for statistical and research purposes and creation of aggregated anonymous data; (ii) to personalize the Services and content provided to you, to customize your experience with the Services and to enable you to retrieve your information; (iii) to study progress and improvements in Personal Physical Profiles; (iv) to use in clinical or academic studies; (v) to develop, improve and customize the Services, the experience of other Users and the offering available through the Services; (vi) to be able to contact Users for the purpose of providing them with technical assistance, support, handle requests and complaints and collect feedback; (vii) to send you updates, notices, announcements, and additional information related to the Services (viii) to be able to reply to User online queries or governmental agencies’ requests; (ix) for customization and improvement of the Services’ accuracy and interface; (x) to use such information for Meta Flow’s commercial purposes; (xi) to display or send to you marketing and advertising material when you are using the Services, including in accordance with the section titled 'Direct Marketing' herein; and (xii) to comply with any applicable rule or regulation.

4. Sharing Information with Third Parties

Meta Flow will not share any Personal or Personal Physical Profile Information it collects with any third party, except in the following cases: (a) to satisfy any applicable law, regulation, legal process, subpoena or governmental request; (b) to enforce this Privacy Policy and/or the TOU, including investigation of potential violations thereof; (c) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to User's support requests; (e) to respond to claims that any content available on the Service or the Site violates the rights of third-parties; (f) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment; (g) to protect the rights, property, or personal safety of Meta Flow, any of its Users, or the general public; (h) when Meta Flow is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets; (i) to share with other Users for such Users who chose to be members of a Social Group; (j) to collect, hold, use, analyze, process and/or manage your Personal Information through Meta Flow’s authorized third party service providers, as reasonable for business purposes (including for purposes of providing and promoting the Services); (k) pursuant to your explicit approval prior to the disclosure; (l) cooperate with third parties for the purposes of adding operational features to the Services, enhancing and personalizing the User's experience, monetization and commercialization; or (m) to authorized third party service providers solely for the purpose of providing you with the Services. Such Meta Flow third party service provider may be located in a country that does not have the same data protection laws as your jurisdiction.

For avoidance of doubt, Meta Flow may transfer and disclose to third parties or otherwise use Non-personal Information (which includes certain Personal Physical Profile Information) at its own discretion.

5. Transfer of Your Information

We may provide Personal Information to third party service providers who assist us in administering and managing our Site, App or Services (such as third parties providing hosting or analytics services). These recipients of Personal Information are not authorized to use the information we share with them for any other purpose. By providing such information, you expressly consent to such transfer and use, including transfers outside of the jurisdiction in which the information was provided.

6. Modification or Deletion of Personal Information

If for any reason you wish to modify, update, revise and/or delete your Personal Information stored with us and identifying to you, or delete your Account from the Services, you may do so by contacting your system administrator (the third party that provided you with access to the Meta Flow Services) or Meta Flow through Services’ appropriate channel (certain changes may be performed through the App or Site while all changes and deletions of Accounts may be done by contacting Meta Flow support at [info@metaflow.co). We will make reasonable efforts to delete any such Personal Information pursuant to any applicable privacy laws or otherwise de-identify any such Personal Information and thereby transform it to become Non-Personal Information. Note that we may retain your Personal Information in accordance with this Privacy Policy for a minimum period required to provide the Services subject to and as required by applicable laws or as required by us for archival purposes.

7. Minors

To open an Account on our Services, you must be over the age of eighteen (18). Without relieving you of your responsibility to comply with the TOU and the terms hereof we reserve the right (without obligation) to request proof of age at any stage so that we can verify that minors under the age of eighteen (18) are not using our Services.

In the event that it comes to our knowledge that a person under the age of eighteen (18) is using our Services, not in accordance with the abovementioned terms, we will prohibit and block such User from accessing our Services and will make all efforts to promptly delete any Personal Information (as such term is defined in herein with regard to such User).

8. Local Storage

When you access or use the Service, we may use industry-wide technologies which temporarily store certain information on the Lumen Device and/or your smartphone or other mobile device (“Local Storage”) and which will allow us to enable automatic activation of certain features, and make your Service experience much more convenient and effortless. The Local Storage used by the Service is created per session and is removed as your session ends, provided that you have completed your attempt to upload User Metabolic Information to the Meta Flow Platform and until such completion the information shall remain on Local Storage. In addition, it is important to note that except for temporary local cache, we do not use any local storage form including cookies in your use of the Site.

9. Direct Marketing

If you provide us with your contact details through the Services (separately from any of your Personal Information), for the purpose of receiving from Meta Flow different offers with respect to the Meta Flow Services, you hereby agree that we may use such contact details, in order to contact you, inform you regarding our products and services which may interest you, and send you other marketing material, including news and updates by transmission to the e-mail address or phone number you have provided.

10. Security

We take a great care in implementing and maintaining the security of the Service and the Site, and our Users’ Personal Information. Our Services, or parts thereof, are hosted on AMAZON AWS, which provides advanced security features. Meta Flow employs industry standard procedures and policies to ensure the safety of its Users’ Personal Information, and prevent unauthorized use of any such information, including secured transmission protocols and SSL and advanced authentication. However, we do not and cannot guarantee that unauthorized access will never occur.

We urge you to use the strongest password combination available on your mobile device and employ reasonable physical security means to protect unauthorized access.

11. Third Party Software/Service

While using the Services we may be using third party software and/or service for various needs, inter alia, in order to collect and/or process the information detailed herein (the “Third Party Service Provider”). Note that these are independent software and/or service providers and Meta Flow does not take any liability about the information collection policies of these providers, or about any kind of issue, legal or otherwise, relating thereto. 12. Changes to the Privacy Policy

Meta Flow reserves the right to change this Privacy Policy at any time, so please re-visit this page frequently. We will provide notice of substantial changes of this Privacy Policy on the Service and/or we will send you an e-mail regarding such changes to the e-mail address that is registered with your Account. Such substantial changes will take effect seven (7) days after such notice was provided on any of the above mentioned methods. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date, and your continued use of the Service or the Site after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.
